قراءة سريعة في قانون مكافأة المُبلغين عن سرقة الأموال العمومية بالسنغال

في خطوة تهدف لتشديد الرقابة على المال
العام، وتشجيع عملية الرقابة عليه بجعلها عملا مدنيا يستحق المكافأة، أقدم البرلمان السنغالي يوم أمس الثلثاء على إجازة قانون يمنح المُبلغين عن المخالفات المالية مكافأة تعادل 10 % من الأصول المستردة.
القانون الجديد جاء بعد مرور سنة من مصادقة البرلمان على قانون يُعنى بتعزيز سلطات المكتب الوطني لمكافحة الاحتيال والفساد (OFNAC) –الجهاز المختص بالتصريح بالممتلكات-، وتوسيع دائرة الأشخاص الملزمين بالتصريح بالممتلكات، وبنشر قائمة المسؤولين الذين لم يمتثلوا لقانون التصريح، وبإرساء رقابة فعالة تضمن الامتثال والدقة والشمولية والصدق في التصريح بالممتلكات، بالإضافة لتحديث عملية الرقابة بما يضمن معرفة مسار تطور ممتلكات الأشخاص المعنيين بالتصريح.

يمثل قانون مكافأة المبلغين عن الفساد قفزة قانونية وثقافية في مسار الحكامة في السنغال. لأن الدولة تمنح بموجبه وضعا خاصا للمواطنين الذين يكشفون عن المخالفات المالية، وتوفر لهم الحماية ضد الانتقام، بل وتمنحهم المكافأة، وتجعلهم لاعبين رئيسيين في معركة الحرب ضد الفساد.
يتكون القانون من 22 مادة، وتُعرف مادته الأولى بدقة المُبلغ عن المخالفات ك”شخص طبيعي يقوم، في إطار أنشطته المهنية، بالإبلاغ أو الكشف بحسن نية عن معلومات تتعلق بالجرائم أو المخالفات المالية، والمخاطر التي قد تلحق بالمصلحة العامة، أو الانتهاكات في إدارة الموارد المالية العامة أو الخاصة”. وحددت نفس المادة قواعد ومجالات الإبلاغ، واستثنت منها ما يتعلق بالمجالات السرية المحمية بموجب القانون كالدفاع والأمن، والتحقيقات القضائية، والأسرار الطبية أو المهنية، والعلاقات بين المحامي وموكله.
أما المادة 3 فنصت على أن الأشخاص الذين يعلنون طواعية عن مشاركتهم في عملية غير قانونية قبل انكشاف أمرهم، يستفيدون من الإعفاء من العقوبة ويمكنهم المطالبة بتعويض مالي. وتتناول المادتين 5 و6 مسار عمل الإبلاغ والمراحل التي يمر بها وإجراءات استقبال ومعالجة الإبلاغ. وتُعفى المادة 10 المُبلغ من أي مسؤولية مدنية أو جنائية عن الأضرار الناجمة عن إبلاغه، طالما أنه يعمل ضمن الإطار القانوني.
وتنص المادة 17 من القانون على إنشاء صندوق خاص لاسترداد الأموال الناتجة عن الاحتيال والفساد والجرائم الاقتصادية والمالية، يستخدم هذا الصندوق لتمويل مشاريع اجتماعية، وكذلك لتقديم مكافآت للمبلغين عن المخالفات. وفقًا للمادة 19، يمكن لكل مُبلغ ساهم إبلاغه في إدانة شخص معين الحصول على مكافأة تعادل 10٪ من المبلغ المسترد، في حين تحيل المادة 20 تقدير تحديد المبلغ للمكتب الوطني لمكافحة الفساد.
يمكن اعتبار هذا القانون نقلة نوعية في نمط الرقابة على المال العام في السنغال، فالسلطات الراهنة يبدو أنها لم تعد مكتفية بجهود الأجهزة الرقابية القائمة لكبح ممارسات الفساد، وباتت تؤمن بضرورة إشراك الجميع من خلال جملة من إجراءات الحماية والتحفيز للحد من الفساد وتأثيراته.
وسيزيد القانون من تصنيف السنغال على مؤشر الشفافية الدولية، وهي البلد الذي احتل الرتبة 70 من بين 180 بلدا على قائمة هذا المؤشر لعام 2023، متقدما بفارق كبير على باقي دول منظمة الاستثمار نهر السنغال (موريتانيا 130، مالي 136، وغينيا 141).
