المجلس الدستوري يُسقط قانون “تفسير العفو العام” الذي تقدم به النائب الباستيفي أمادو باه
في قرار مفصلي أعلن المجلس الدستوري السنغالي يوم الأربعاء عدم دستورية قانون تفسير العفو العام الذي أقره البرلمان في 2 أبريل 2025، بمبادرة من النائب عن حزب “باستيف” أمادو باه وبدعم من الأغلبية البرلمانية.
القانون كان يهدف إلى توضيح حدود العفو العام الذي أُقر في مارس 2024 في عهد الرئيس السابق ماكي سال، والذي شمل المخالفات المرتبطة بالتظاهرات السياسية بين فبراير 2021 وفبراير 2024 ما أتاح الإفراج عن عدد من المعارضين البارزين، بينهم الرئيس الحالي بشير جوماي فاي ورئيس وزرائه عثمان سونكو.
لكن النسخة التفسيرية الجديدة سعت إلى استثناء الجرائم الجسيمة – مثل القتل والتعذيب – من هذا العفو.
غير أن 17 نائبًا من المعارضة بقيادة عيشة تال سال، اعتبروا أن القانون تجاوز دوره التفسيري وأدخل تعديلات قانونية جوهرية، ما يشكل انتهاكًا للدستور، فقدموا طعنًا إلى المجلس الدستوري يوم 22 أبريل.
القرار الصادر عن ستة من أعضاء المجلس السبعة جمد تلقائيًا توقيع القانون من قبل الرئيس واعتبره غير متوافق مع الدستور.
